UNIQUE CLINICS

Beyond the Bases is offering a variety of clinics that are designed to teach and provide repetitions for specific skills required of baseball players.  These clinics are designed and taught by skilled former professional players, coaches, scouts and trainers.  Unlike traditional clinic models that focus on several topics, Beyond the Bases clinics will focus in on isolated skills.  In doing so, each young athlete should leave the clinic with a solid understanding of the curriculum and begin to use their new skill the next time they step on the diamond.

By checking this box and registering, I certify that I am the parent/legal guardian of the participant and that I have read, understand, and agree to the Informed Consent, Assumption of Risk, Waiver, Indemnification, and Media Release Agreement. I acknowledge that participation involves inherent risks of injury, including serious injury or death, and I voluntarily assume those risks on behalf of the participant. I agree to indemnify and hold harmless Beyond the Bases, LLC from any claims arising out of participation. I also consent to emergency medical treatment and acknowledge that no insurance is provided. I further agree to the use of the participant’s name, image and likeness for promotional purposes. I understand that this agreement is governed by New York law and contains a binding arbitration provision. Any participant under the age of eighteen (18) (the “Participant”) must be registered by a parent or legal guardian (“Guardian”), who agrees to the following terms on behalf of themselves and the Participant. 1. Nature of Activities and Inherent Risks Guardian acknowledges that Beyond the Bases, LLC (“Company”) provides baseball-related instructional clinics, showcases, and related activities (collectively, the “Activities”), which are inherently hazardous. Guardian understands and acknowledges that participation in baseball and related training activities involves known and unanticipated risks, including but not limited to: -Being struck by balls, bats, or equipment -Physical contact or collisions with other participants -Falls, slips, or trips -Overexertion, dehydration, or heat-related illness -Improper or failed use of equipment -Acts or omissions of other participants, coaches, or third parties Guardian understands that these risks cannot be eliminated without fundamentally altering the nature of the Activities, which would nullify the purpose of the Activities. 2. Acknowledgment and Assumption of Risk Guardian, on behalf of themselves and the Participant, knowingly and voluntarily assumes all risks of participation, both known and unknown, inherent or otherwise, even if arising from the acts or omissions of others. Guardian expressly acknowledges that they are aware of the risks and are choosing to allow Participant to engage in the Activities despite those risks. 3. Health and Fitness Representation Guardian represents that Participant is physically fit to participate and has no condition that would make participation unsafe. Guardian acknowledges responsibility for consulting a physician prior to participation. 4. Release of Liability To the fullest extent permitted by New York law, Guardian, on behalf of themselves and the Participant, releases and discharges Beyond the Bases, LLC and its owners, members, managers, employees, coaches, independent contractors, affiliates, sponsors, and facility providers (collectively, the “Released Parties”) from claims arising out of Participant’s participation in the Activities. Guardian understands that certain liability waivers may be limited under New York law, and this provision is intended to be enforced to the maximum extent allowed. 5. Indemnification Guardian agrees to indemnify, defend, and hold harmless the Released Parties from any and all claims, liabilities, damages, losses, or expenses (including attorneys’ fees) arising out of or related to: -Participant’s participation in the Activities -Any claim brought by or on behalf of the Participant -Any injury, loss, or damage caused by the Participant 6. Medical Authorization Guardian authorizes the Company to obtain emergency medical care for Participant if necessary and agrees to be financially responsible for all associated costs. 7. No Insurance Guardian acknowledges that the Company does not provide health, accident, or liability insurance for Participants. 8. Media Release Guardian grants the Company the unrestricted right to use Participant’s name, image, likeness, and voice in any media for promotional or business purposes without compensation. 9. Third-Party Facilities Guardian acknowledges that Activities may occur at third-party facilities and agrees that the Company is an intended beneficiary of any waivers signed at such facilities. 10. Arbitration, Jurisdiction and Venue All disputes involving Guardian, Participant and Company shall be governed by New York Law and any dispute shall be resolved through binding arbitration in New York, venue to be Nassau County, using the AAA rules in National Arbitration and Mediation in Garden City and Guardian agrees to waive the right to a jury trial to the extent permitted by law. 11. Limitation of Claims Any claim must be brought within one (1) year, to the extent such limitation is permitted under New York law. 12. Severability If any provision of this Informed Consent, Assumption of Risk, Waiver, Indemnification and Release is found unenforceable, the remaining provisions shall remain in effect. 13. Acknowledgment Guardian confirms they have read and understand this agreement and are voluntarily agreeing to its terms.
